Terms of Service

1. Eligibility

You must be at least 16 years old to use GainBuddy. If you are under the age of majority where you live, you confirm a parent or guardian has reviewed these Terms with you. You may not use the service if you have been previously banned, or where prohibited by law.

2. Description of the Service

GainBuddy provides nutrition tracking (including barcode and label scanning), evidence-based calorie and macronutrient targets, training programs and a form-video library, AI-assisted estimates, meal planning, and community and rewards features. Features may change over time. Some features require a paid subscription.

3. Health and Fitness Disclaimer

• Consult a physician before starting any diet or exercise program, especially if you are pregnant or breastfeeding, have a medical condition (including diabetes, heart, kidney or eating disorders), take medication, or are recovering from injury.
• Stop exercising and seek medical help if you feel pain, dizziness, shortness of breath or discomfort.
• Body-composition and nutrition estimates are approximations and may be inaccurate. Barcode and label data come from third-party databases and user submissions and may contain errors.
• You exercise at your own risk and are responsible for using proper form, equipment and supervision.
• If you are struggling with food, weight or body image, please reach out for support — in the US the National Eating Disorders Association, in Israel ANAD Israel — or your local emergency services in a crisis.

4. Account Registration and Security

Provide accurate information and keep your credentials confidential. You are responsible for activity under your account. Enable two-factor authentication for extra protection and tell us immediately at support@gainbuddy.fit if you suspect unauthorised use. One person, one account.

5. Subscriptions, Free Trials, Auto-Renewal and Refunds

• Plans. We offer Nutrition, Training and bundled subscriptions, billed monthly or yearly. Prices are shown in the app in your local currency before purchase.
• In-app purchase. Subscriptions are purchased through the Apple App Store or Google Play and are subject to their terms. Payment is charged to your store account at confirmation of purchase.
• Free trial. Eligible new subscribers get a 7-day free trial (or 14 days when invited by a friend). Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription. Any unused portion of a free trial is forfeited when you purchase.
• Auto-renewal. Subscriptions renew automatically at the then-current price for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the period.
• Cancelling. Manage or cancel in your device settings: iOS — Settings → your name → Subscriptions; Android — Google Play → Payments & subscriptions → Subscriptions. Deleting the app or your account does not cancel a store subscription. After cancelling you keep access until the end of the paid period.
• Refunds. Refunds are handled by Apple (reportaproblem.apple.com) or Google under their policies; we cannot issue refunds for store purchases directly. Where mandatory law gives you a withdrawal right, you can exercise it through the store.
• Price changes. We will give advance notice of price increases as required by the stores and applicable law; you may cancel before the new price applies.
• Free tier. Some features are free with limits (for example a daily number of barcode scans). We may change free-tier limits.

6. Referral Program Terms

• Each user gets a personal invite code and link. Friends who sign up with it receive an extended 14-day free trial when they start their first subscription.
• When an invited friend becomes a paying subscriber (after any trial), the inviter receives 1 month of premium access as a promotional entitlement, plus in-app XP and badges. Rewards stack by extending the promotional period.
• A friend can be referred only once, must be a genuinely new customer, and must sign up within 7 days of following the invite. Self-referrals, multiple accounts, referrals from the same device, automated or incentivised sign-ups, and posting codes on coupon sites or in paid advertising are not allowed.
• We may withhold, reverse or cancel rewards obtained in violation of these rules, and suspend accounts involved in referral abuse. Rewards have no cash value and are not transferable.
• We may modify or end the referral program at any time; rewards already earned will be honoured.

7. User Content and Community Guidelines

You own the content you post (posts, photos, comments). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display and distribute it within the service to the audience you select, solely to operate and improve the service. The licence ends when you delete the content or your account, except for copies other users have already shared within the app or that we must retain by law.

Product photos. When you choose to share a photo of a packaged product (not a meal or a person) as that product's picture, you license it under the Creative Commons Attribution-ShareAlike 3.0 licence. We may edit it (for example, remove the background), show it to all users, and share it and our edited version with Open Food Facts under the same licence, credited to “GainBuddy community” rather than your name. Shared product photos are reviewed before they appear. Because the licence is public and cannot be withdrawn, deleting your account removes your original photo from our storage but not copies already published or shared with Open Food Facts. Only share photos you took yourself.

You must have the rights to what you post and must follow our Community Guidelines. In short: no harassment, hate, sexual content, content promoting eating disorders, self-harm or dangerous weight-loss practices, misinformation about health, impersonation, spam or illegal content, and never post photos of other people without their consent.

We may remove content and restrict accounts that violate these rules. You can report content and block users in the app; we review reports and act promptly. If you believe content infringes your copyright, email support@gainbuddy.fit with the details required by applicable law.

8. Acceptable Use

Do not: reverse engineer, scrape or bulk-download the service or its food database; access other users' data; probe or bypass security or rate limits; use bots or automation; resell the service; upload malware; or use the service to violate any law. Responsible security research is welcome under our disclosure policy.

9. AI Features

Some features use third-party AI models. AI output may be inaccurate or incomplete; review it before relying on it (for example, check label values against the package). Do not upload images of other people or images you have no right to use. We do not use your content to train AI models.

10. Kosher, Halal and Other Dietary-Law Information

Kosher and halal settings, certification badges (“Matches your standard”, “Different certification”, “Unknown — check the package”) and meal-plan rules such as waiting times between meat and dairy are a convenience only. Certifications are detected automatically from Open Food Facts labels, product or package photos (read by AI) and reports from other users. They can be missing, outdated or wrong — products and certifications change, and photos can be misread.

We are not a kashrut or halal certifying authority and do not rule on what is kosher or halal. Always check the certification symbol on the package yourself and follow your own rabbi, imam or certifying body. To the extent permitted by law, we are not responsible for any reliance on this information.

11. Third-Party Services

The service integrates third-party services (Apple, Google, RevenueCat, food databases such as Open Food Facts and USDA FoodData Central). Their terms and privacy policies govern your use of them, and we are not responsible for their content or availability. Open Food Facts data is available under the Open Database License.

12. Intellectual Property

The service, including software, design, training programs, exercise videos, text and trademarks, is owned by GainBuddy Ltd. or its licensors and protected by law. We grant you a personal, non-transferable, revocable licence to use the app for its intended purpose under these Terms.

13. Disclaimers

To the extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of nutritional data or estimates, and uninterrupted availability. We do not guarantee any particular health, weight or fitness result.

14. Limitation of Liability

To the extent permitted by law, GainBuddy Ltd. is not liable for indirect, incidental, special, consequential or punitive damages, or for injury resulting from exercise or dietary choices you make. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud) or your statutory consumer rights.

15. Indemnification

You agree to indemnify GainBuddy Ltd. against claims arising from content you post or your violation of these Terms or of others' rights, to the extent permitted by law.

16. Termination

You may stop using the service and delete your account at any time (how). We may suspend or terminate accounts that violate these Terms or create risk for others, with notice where reasonable. Sections that by their nature should survive (licences to already-shared content, disclaimers, liability limits, dispute terms) survive termination.

17. Governing Law and Disputes

These Terms are governed by the laws of [jurisdiction — counsel to confirm], without regard to conflict-of-law rules. Courts in [venue] have jurisdiction, except that consumers may bring claims in their place of residence and keep the protection of mandatory local consumer law. Before filing a claim, please contact us so we can try to resolve it informally within 30 days.

18. Changes to These Terms

We may update these Terms. We will notify you of material changes in the app or by email before they take effect. Continuing to use the service after the effective date means you accept the new Terms; if you do not agree, delete your account.
